Privacy Policy

What we collect, why we collect it, how long we keep it, and what you can ask us to do with it.

smkcloud.tech of Houston, Texas is the controller of personal data processed through ServerMonkey Cloud.

1. What we collect

  • Account data — name, email, phone, company and billing address, given when you register or order.
  • Billing data — invoices, payments and tax identifiers. Card numbers are handled by our payment processors; we store only a token and the last four digits.
  • Service data — the servers and resources on your account, their addresses, and operational metrics.
  • Support data — tickets, live chat transcripts and call notes.
  • Technical logs — IP addresses, timestamps and user agents for access to the client area, kept for security and abuse investigation.

We do not access the content stored on your servers except where necessary to operate the service, to comply with a legal obligation, or where you ask us to as part of support.

2. Why we process it

  • To perform the contract — provisioning, billing, support and service notices.
  • Legitimate interests — fraud prevention, network security, abuse handling and improving the service.
  • Legal obligation — tax records, and responding to lawful requests.
  • Consent — where you have opted in to something specific. You can withdraw it at any time.

3. Marketing

We have never sent a marketing newsletter and do not plan to start. Emails we send are transactional: deploy receipts, invoices, incident notices and maintenance windows. You cannot unsubscribe from invoices, but you can choose which contacts on your account receive which categories.

4. Who we share it with

We share personal data only with processors who help us run the service — payment processors, email delivery, fraud screening and accounting — each under contract and only for those purposes. We do not sell personal data. We disclose data to authorities only where legally compelled, and we will tell you unless prohibited from doing so.

5. Where it is stored

Customer server data resides in our Houston, Texas facility. Account and billing records are held in systems located in the United States. Where a processor operates outside the US, transfers are covered by standard contractual clauses.

6. How long we keep it

  • Account and billing records: seven years after the account closes, for tax and accounting purposes.
  • Support tickets: three years after closure.
  • Access and security logs: twelve months.
  • Server data on terminated services: deleted following the retention window described in your termination notice.

7. Your rights

Depending on where you live you may have the right to access, correct, delete, port or restrict processing of your personal data, and to object to processing based on legitimate interests. California residents have rights under the CCPA, including the right not to be discriminated against for exercising them.

To exercise any of these, write to privacy@smkcloud.tech. We respond within 30 days and do not charge for reasonable requests.

8. Cookies

The client area sets a session cookie required to keep you signed in, and a preference cookie recording your light or dark theme choice. Neither is used for advertising. If you arrive through an affiliate link, an attribution cookie is set for 90 days.

9. Security

Access to customer data is restricted to staff who need it, over authenticated and logged channels. Two-factor authentication is available on all customer accounts and required for all staff accounts. If a breach affects your personal data we will notify you and the relevant authority as required by law.
