Acceptable Use Policy
What you may and may not run on our infrastructure. Short version: do not break the law, do not endanger the network, and do not make yourself somebody else’s problem.
This policy forms part of the Terms of Service and applies to everyone using ServerMonkey Cloud services, including your own customers if you resell.
1. Prohibited content and activity
You may not use the services to host, transmit or facilitate:
- Anything unlawful under United States or Texas law.
- Child sexual abuse material. Reports go straight to law enforcement and the account is terminated immediately, without notice or refund.
- Material infringing someone else's copyright, trademark or other rights.
- Malware, ransomware, exploit kits, phishing pages or credential-harvesting infrastructure.
- Command-and-control infrastructure for botnets or compromised hosts.
- Unsolicited bulk email, or infrastructure supporting it — including hosting the sites advertised in spam sent elsewhere.
2. Network conduct
You may not:
- Launch denial-of-service attacks, or knowingly participate in amplification or reflection.
- Port scan, brute force or otherwise probe systems you do not own without documented authorisation.
- Spoof source addresses, or announce address space you do not control.
- Run open resolvers, open relays or open proxies that can be abused for amplification.
- Take deliberate action that degrades service for other customers.
Security research and penetration testing against your own systems is fine. Testing against third parties requires written authorisation, and we may ask to see it.
3. Email
Ports 25 and 587 are closed on new services by default. We open them on request after a short conversation about what you are sending. If you send bulk mail, you must operate a verifiable opt-in list, honour unsubscribes promptly and maintain SPF, DKIM and DMARC. Sustained complaint rates will get the ports closed again.
4. Resource use
Dedicated and VPS resources are yours to saturate — that is what you are paying for. What is not acceptable is deliberately circumventing the resource limits of your plan, or using shared components in a way that damages other customers.
Bandwidth allowances are stated per product. Exceeding one is a billing conversation, not a policy breach.
5. Reporting abuse
Send reports to abuse@smkcloud.tech with logs, including timestamps in UTC and the source and destination addresses. We acknowledge reports promptly and investigate every one. Anonymous reports are accepted but harder to act on.
6. How we enforce this
Our normal approach is to contact you first and give you a reasonable chance to fix the problem — most breaches are a compromised customer, not a malicious one. Where the conduct is severe, ongoing, or endangers the network or other customers, we may suspend the service immediately and investigate afterwards.
Repeated or deliberate breaches lead to termination without refund. We reserve the right to report unlawful activity to the authorities, and to preserve evidence where asked to.
7. Appeals
If you believe a suspension was made in error, open a ticket marked urgent. A human will review it, and we will restore service quickly where we got it wrong.
